Gujarat Government Announces Major Stamp Duty Relief for Family Property Transfers
The Gujarat state government, in a significant move aimed at easing property division among family members, announced on Friday a substantial relaxation in stamp duty provisions for internal land transactions. The decision specifically targets transactions among lineal and collateral heirs, replacing the existing jantri-based stamp duty with a nominal flat fee.
Flat Rs 300 Stamp Duty for Relinquishment and Partition Deeds
According to an official government statement, when one or more heirs among joint holders recorded under inheritance entries choose to relinquish their rights in favour of other heirs, a stamp duty of only Rs 300 will now be charged on each deed of relinquishment or reduction of rights. This marks a drastic reduction from the previous jantri-based calculations, which often resulted in significantly higher costs.
The new policy extends to partition deeds as well. Where joint account holders entered under inheritance records undertake partition over time—whether in a single stage or multiple stages involving lineal heirs or, in their absence, collateral heirs—each partition deed will attract the same flat stamp duty of Rs 300. This streamlined approach is designed to simplify the legal process and reduce financial barriers.
Inclusion of Collateral Heirs and Lifetime Entries
The government has also clarified that in cases where no lineal heir is alive, rights may be relinquished in favour of one or more collateral heirs. Furthermore, for the entry of names during the lifetime of the property holders as well as for partition, each such change deed will be subject to the reduced stamp duty of Rs 300. This inclusive provision ensures that a wider range of family transactions can benefit from the new policy.

The government emphasized that this decision is expected to yield multiple positive outcomes. By making property division among family members easier and more affordable, it is anticipated to significantly reduce disputes and court cases related to inheritance. This move promotes proper legal documentation and encourages the registration of transactions that have historically remained undocumented due to the prohibitive costs associated with higher stamp duties.
