The Kerala High Court on Monday quashed a Public Interest Litigation (PIL) that challenged the state government's free bus travel scheme for women and transgender persons. The court termed the scheme a progressive welfare measure aimed at promoting gender equality and social inclusion.

PIL Filed by Self-Described Public-Spirited Citizen

The PIL was filed by Muhammed Firdouz, who described himself as a public-spirited citizen and taxpayer. He argued that the scheme was discriminatory against men and violated the principle of equality under the Constitution. The petition sought to declare the scheme unconstitutional and to direct the government to withdraw it.

Court's Ruling: Scheme is a Valid Welfare Measure

A division bench of Justice A. Muhamed Mustaque and Justice P. Gopinath dismissed the PIL, observing that the scheme is a valid welfare measure designed to address historical disadvantages faced by women and transgender persons. The court noted that the government has the power to frame policies for the upliftment of marginalized sections, and such affirmative action does not violate equality provisions.

“The scheme is intended to provide safe and affordable transportation to women and transgender persons, thereby enhancing their access to education, employment, and public spaces,” the bench stated in its order.

Government Defends the Scheme

During the hearing, the state government defended the scheme, highlighting that it has benefited over 3.5 lakh women and transgender persons since its launch in April 2026. The government argued that the scheme is a part of its commitment to gender justice and does not impose any undue burden on the exchequer, as the cost is borne by the state budget.

According to government data, the scheme has led to a 15% increase in the number of women using public transport, reducing their dependence on private vehicles and contributing to environmental sustainability.

Impact and Reactions

The court's decision has been welcomed by women's rights groups and transgender activists. “This is a victory for inclusive governance. The scheme has empowered thousands of women and transgender persons by providing them with mobility and independence,” said a spokesperson for the Kerala Women's Commission.

The PIL petitioner, Muhammed Firdouz, expressed disappointment but accepted the court's verdict. He said he had filed the petition in public interest, believing the scheme was unfair to other sections of society.

The free bus travel scheme is a flagship initiative of the Kerala government, implemented by the Kerala State Road Transport Corporation (KSRTC). It allows women and transgender persons to travel for free on all KSRTC buses within the state, including city services and long-distance routes.
