The special excise court in Buxar has sentenced a man convicted of liquor smuggling to 10 years of rigorous imprisonment and imposed a fine of Rs5 lakh. In case of non-payment of the fine, the convict will have to undergo an additional one year of imprisonment.
Verdict Delivered by Additional District and Sessions Judge
The verdict was delivered on Friday by Additional District and Sessions Judge-II-cum-Special Judge (Excise), Buxar. The convict, Manu Mishra, son of Dinanath Mishra, is a resident of Civil Lines under Buxar town police station area.
Details of the Incident
Special public prosecutors Awadhesh Kumar Rai, Ravindra Kumar Singh and Shyam Shrichandra said that on January 28 this year, around 6pm, an excise department team was conducting a vehicle-checking drive at Veer Kunwar Singh Setu in the Town police station area. During the inspection, officials intercepted a youth coming from Uttar Pradesh.
A search led to the recovery of 4.140 litres of foreign liquor from his possession. Following the seizure, a case was registered on the statement of Basanti Kumari, assistant inspector of Buxar excise police station, and the accused was arrested.
Trial and Sentencing
During the trial, the prosecution established the charges through documentary evidence and witness testimonies. Based on the evidence presented, the court found the accused guilty and awarded the sentence. The court emphasized the seriousness of liquor smuggling and its impact on society, leading to the stringent punishment.
The convict has been given time to appeal the verdict. The fine, if recovered, will be deposited in the state exchequer.
