Rajasthan High Court Takes Up Neerja Modi School's Challenge Against CBSE
A single-judge bench of the Rajasthan High Court issued a notice to the Central Board of Secondary Education on Friday. The court acted on a petition filed by Neerja Modi School in Jaipur. The school is challenging CBSE's decision to withdraw its affiliation for senior secondary classes.
Legal Battle Over Affiliation Withdrawal
Justice Bipin Gupta issued the notice while hearing the petition filed under Article 226 of the Indian Constitution. The school is contesting CBSE's order dated December 30. That order withdrew the school's affiliation with immediate effect.
The court also heard petitions from some parents. Their children will now have to change schools due to the affiliation withdrawal.
School's Arguments Against CBSE Decision
Senior counsel AK Sharma and Rachit Sharma represented Neerja Modi School in court. They presented several arguments defending the institution.
The school maintains an excellent academic and administrative record. It has operated for more than twenty-five years without any blemishes. The student strength currently exceeds 5,500 pupils.
CBSE had previously granted the school an extension of affiliation. This extension was valid until March 31, 2029.
Background of the Controversy
CBSE withdrew its affiliation after a tragic incident involving a Class 4 student. The student allegedly died by suicide within the school premises.
The school's legal team called CBSE's action arbitrary and disproportionate. They argued it violated principles of natural justice.
The extreme penalty of immediate withdrawal was imposed without proper consideration of facts. The school claims it did not receive adequate opportunity for a hearing.

The counsels emphasized the severe consequences of the affiliation withdrawal. They stated it would prejudice not just the institution but thousands of enrolled students.
These students face potential jeopardy to their academic futures. Many might need to find new schools mid-academic year.

After hearing arguments from both sides, Justice Gupta issued notices to several CBSE officials. These include:
