Maharashtra Government Grants Full Waiver on Development Charges to Tata Memorial Hospital

The Urban Development Department of Maharashtra has issued a significant notification, completely waiving all development charges and premiums for the globally renowned Tata Memorial Hospital. This decision comes in recognition of the hospital's critical role in cancer care and its limited financial resources to cover the substantial fees typically required for building development across the state.

Comprehensive Exemption Across All Projects

According to the official notification, Tata Memorial Hospital will now be treated on par with state government entities. It is exempted from paying development charges and development cess levied under the Development Control and Promotion Regulations (DCPR) for all its projects throughout Maharashtra. This exemption applies not only to main hospital buildings but also to ancillary structures such as staff quarters, dharamshalas (guest houses), and administrative buildings.

Specific Projects Benefiting from the Waiver

Officials have clarified that the premium waiver will directly benefit several key expansion initiatives:

  • The major expansion project at the Parel campus on the Haffkine Bio Pharma Corporation Ltd plot, where the Brihanmumbai Municipal Corporation (BMC) had previously demanded approximately Rs 250 crore in premiums.
  • The establishment of a 100-bed hospital at Tambati in Raigad district through the Integrated Ayurvedic Cancer Hospital and Research Centre.
  • The development of the women and children's wing at the Kharghar hospital facility.

With this waiver, the hospital is relieved from paying the Rs 250 crore premium for the Parel expansion, a substantial financial burden that has been eliminated.

Continuation of Previous Government Support

This move follows earlier government support for the institution. In 2025, the state cabinet had already waived stamp duty for the Tata Memorial Cancer Research Centre and Hospital in Raigad. That decision specifically approved the waiver of stamp duty on the lease agreement for 10 hectares of land allocated for the 100-bed hospital at Tambati through the Integrated Ayurvedic Cancer Hospital and Research Centre.

Legal Framework for the Exemption

Officials explained that development charges and premiums are normally levied on any land or building development in Maharashtra under Section 124(a) of the Maharashtra Regional and Town Planning (MRTP) Act, 1966. However, Section 124(f) of the same Act provides exemption from these charges for properties owned by the state government, central government, and local authorities. By extending this exemption to Tata Memorial Hospital, the government has effectively placed the institution in the same category as these public entities for development charge purposes.

The decision underscores the state government's commitment to supporting healthcare infrastructure, particularly in the critical area of cancer treatment and research, by removing financial barriers to expansion for one of India's most important medical institutions.
