Bengaluru Court Sentences Driver to Jail for Fatal Road Accident
A magistrate court in Bengaluru has delivered a verdict in a tragic road accident case, convicting a 28-year-old driver for causing the death of an auto driver. The court imposed a sentence of three months' simple imprisonment and a fine of Rs 3,000 on the convict, identified as M Rehman Saab, a resident of Laggere.
Details of the Accident and Legal Proceedings
The incident occurred on May 3, 2023, around 11:40 pm near Laggere bridge in Nandini Layout. Rehman was driving his mini goods vehicle back home when it rear-ended an autorickshaw driven by 19-year-old Yogesh SN from Jai Marutinagar. The collision resulted in Yogesh and his friend Ningaraju being thrown out of the vehicle. Tragically, Yogesh succumbed to head injuries, while Ningaraju recovered from the accident.
Following the accident, the Rajajinagar traffic police filed a charge sheet against Rehman under sections 279 (rash and negligent driving) and 304A (causing death due to negligence) of the then Indian Penal Code. The prosecution built its case on strong evidence presented during the trial.
Evidence and Conviction
Assistant Public Prosecutor Girija Shankar highlighted that the conviction was secured through a combination of eyewitness testimonies and thorough documentation by investigating officers. "Around four eyewitnesses provided statements that were corroborated with key documents such as the spot mahazar," Shankar explained. "The investigating officer meticulously recorded accident details with required sketches, and the police obtained a confession statement from Rehman, which played a vital role in the case."
The court found the evidence compelling, leading to Rehman's guilt being established beyond reasonable doubt. This verdict underscores the legal consequences of negligent driving and aims to serve as a deterrent for road safety violations.
