Bombay High Court Delivers Scathing Rebuke to Maharashtra Government Over Minister's Son Evading Arrest

The Bombay High Court on Thursday issued a sharp and unprecedented criticism of the Maharashtra government, raising fundamental questions about whether the rule of law truly prevails in the state. Justice Madhav Jamdar, while hearing applications related to violent clashes during the Mahad Municipal Council elections in Raigad district, directly questioned whether Chief Minister Eknath Shinde was too "helpless" to take action against a cabinet minister whose son has been successfully avoiding arrest for several weeks.

Background of the Political Violence Case

The controversy stems from violent incidents that erupted on December 2 during civic polls between supporters of two political factions that are both allies in the BJP-led state government. The clash involved supporters of the Eknath Shinde-led Shiv Sena and the Ajit Pawar-led Nationalist Congress Party (NCP), leading to cross FIRs being registered by authorities.

The case specifically involves Vikas Gogawale, son of Shiv Sena minister Bharat Gogawale, and Shreeyansh Jagtap, son of former MLA Manik Jagtap who is a prominent NCP leader. While Vikas Gogawale and his cousin Mahesh were denied pre-arrest bail in the matter, Shreeyansh Jagtap received interim protection from arrest back in December.

Court's Stern Questions About Law Enforcement

Justice Jamdar expressed deep concern over the police's apparent inability to arrest the minister's son even after his anticipatory bail plea was rejected by a sessions court. The judge posed pointed questions that struck at the heart of governance and law enforcement in Maharashtra.

"Is the state's chief minister so helpless that he cannot say anything against even one minister?" Justice Jamdar asked during the hearing. "Ministers' children commit crimes and roam freely ... they remain in touch with their parents, yet the police cannot find them?"

The judge further emphasized that while police might face political pressure in such sensitive cases, "there is no pressure on the court," and questioned whether law and order was being effectively enforced in the state. These remarks represent one of the strongest judicial interventions in recent memory regarding political influence on law enforcement agencies.

Government's Response and Court Directions

Following the court's stern rebuke, the Maharashtra government moved quickly to assure compliance with judicial expectations. Advocate General Milind Sathe informed the bench that the minister in question would ensure his son's surrender within a single day.

The court accepted this assurance but maintained judicial oversight by directing Vikas Gogawale to surrender before the next hearing. The matter has been scheduled for further proceedings on Friday, keeping pressure on all parties involved to follow through on their commitments.

This case highlights the ongoing tensions between political influence and judicial independence in Maharashtra, particularly concerning high-profile individuals connected to powerful political families. The Bombay High Court's intervention serves as a significant reminder that judicial institutions remain vigilant about maintaining the integrity of law enforcement processes, even when they involve politically sensitive figures.
