The Central government has approached the Supreme Court seeking the transfer of all petitions challenging the transgender rights law from various high courts across the country. The law officer argued that with multiple high courts currently hearing the matter, there is a significant risk of divergent views and conflicting judicial rulings on the validity of the federal legislation.

Background of the Transgender Law

The Transgender Persons (Protection of Rights) Act, passed by Parliament, aims to safeguard the rights of transgender individuals. However, several petitions have been filed in different high courts questioning certain provisions of the law, including those related to self-identification and access to healthcare.

Government's Concern

The government's move is intended to ensure uniformity in legal interpretation. The Solicitor General emphasized that a single bench of the Supreme Court should adjudicate all matters to avoid contradictory orders that could create confusion and hinder the implementation of the law.

This is not the first time the Centre has sought consolidation of cases. Similar transfers have been requested in the past for issues like the Citizenship Amendment Act and the National Register of Citizens.

The Supreme Court is yet to schedule a hearing on the transfer petition. Legal experts believe that the court may consider the government's plea given the complexity and sensitivity of the issues involved.
