Constable's PSI Bid Fails Over Height, Court Warns of Fraud Risk

Gujarat Constable's Career Ambition Halted by Height Measurement Dispute

In 2019, Bonykumar Kapadia successfully joined the Gujarat state police force as a constable after clearing the physical efficiency test, which required a minimum height of 165cm and completion of a 5km run within 25 minutes. Six years later, his aspiration to advance his career by becoming a police sub-inspector encountered a significant obstacle when he was found not to meet the same minimum height eligibility of 165cm in two subsequent physical examinations.

Court Intervention and Height Remeasurement Process

Kapadia, who has been serving as a constable since 2019, applied for the PSI position during an ongoing recruitment drive. During the physical test, officials declared him ineligible, stating he fell short of the required height. Along with several other candidates, Kapadia approached the Gujarat High Court, seeking a remeasurement. The court permitted this but imposed strict conditions: the measurement would be conducted at Sola Civil Hospital under videography, and each candidate had to deposit Rs 10,000, which would be forfeited if their claim failed. Despite this opportunity, Kapadia again failed to meet the height requirement.

Legal Proceedings and Judicial Warnings

On February 26, the high court disposed of the case after the petitioners' advocate withdrew the petition. While this ended the matter for others, Kapadia returned to court on Thursday, arguing that since he had been serving as a constable under the same height standard, his initial clearance should validate his eligibility now. This prompted Justice Nirzar Desai to question Kapadia's counsel, asking, "Do you think a person will start shrinking?" When the advocate raised concerns about measurement accuracy, the court emphasized that the process had been recorded on video, ensuring transparency.

Risk of Losing Current Position and Final Withdrawal

The court indicated it could order a third measurement but issued a stern warning: if Kapadia failed again, it could imply he secured his constable job fraudulently, potentially leading to the loss of his current position. The court explicitly asked if Kapadia was prepared to risk his existing job to pursue the promotion. Faced with this high-stakes scenario, Kapadia chose to play safe and withdrew his application, effectively ending his bid for the PSI role.

This case highlights the stringent physical standards in police recruitment and the legal complexities that can arise when candidates challenge eligibility criteria. It underscores the importance of accurate measurements and the potential consequences of discrepancies in such processes.
