Election Commission Grants MCC Clearance for Kerala Cabinet Meeting on Anti-Ragging Bill
The Election Commission of India (EC) has officially informed the Kerala High Court that it has granted Model Code of Conduct (MCC) clearance to the state government. This permission allows the government to convene a cabinet meeting specifically for the finalization of the draft Kerala Prohibition of Ragging (Amendment) Bill.
High Court Observations and Legal Proceedings
Noting this submission, a bench comprising Chief Justice Soumen Sen and Justice C Jayachandran observed that, in light of the clearance from the Election Commission, there is no legal impediment to convening a cabinet meeting to finalize the Bill, even with the MCC in force. Consequently, the court adjourned the petition filed by the Kerala Legal Services Authority (KeLSA), which seeks effective measures to eradicate ragging, to June 10.
Background of the Petition and Ragging Incident
KeLSA had filed this petition following a severe ragging incident at the Government College of Nursing in Kottayam last year. In this disturbing case, junior students were allegedly subjected to severe physical abuse, including being forced to tie dumbbells to their private parts. This incident highlighted the urgent need for stronger anti-ragging legislation in the state.
Previous Court Hearings and Delays
During the last hearing on March 31, the High Court had expressed its unhappiness with the progress in finalizing the draft Bill. Despite earlier assurances that the Bill would be placed before the cabinet promptly, it was later submitted that, with the assembly election announced and the MCC coming into force, convening a cabinet meeting was not feasible. In response, the court had directed the law secretary to appear in court to explain the delay. Additionally, the additional chief secretary (home) was instructed to approach the Election Commission for an exemption from the MCC and permission to convene a cabinet meeting for finalizing the draft Bill.
Recent Developments and EC Communication
On Friday, a communication from the Election Commission to the chief electoral officer of Kerala, granting permission to convene a cabinet meeting, was presented before the court. This development led the High Court to adjourn the matter, enabling the convening of a cabinet meeting to finalize the Bill. The court's decision underscores the priority given to addressing ragging through legislative measures, even during election periods.
The adjournment provides the state government with a crucial window to advance the anti-ragging amendments, aiming to enhance protections for students across Kerala. This move is seen as a significant step toward combating ragging and ensuring a safer educational environment in the state.
