Kerala High Court Grants Conditional Approval for Road Widening at Ecologically Sensitive Madayipara

The Kerala High Court has issued a landmark order permitting the widening of a road leading to the Sree Madayikavu Bhagavathi Temple in Kannur district, but with stringent environmental conditions aimed at preserving the unique biodiversity of the Madayipara plateau. A bench comprising Justices V Raja Vijayaraghavan and K V Jayakumar delivered the judgment in response to petitions filed by local residents, including C K Vijeesh of Kannur, who challenged the project over ecological concerns.

Balancing Development and Conservation at a Biodiversity Hotspot

The court acknowledged that Madayipara is an ecological paradise and a biodiversity hotspot, covering approximately 600-700 acres as a flat-topped laterite plateau near Pazhayangadi on the banks of the Kuppam River. Rising 40-47 meters above sea level, it offers panoramic views of nearby wetlands and the Ezhimala coast. The area is renowned for its rich flora and fauna, hosting over 500 plant species—including rare and endemic varieties—along with diverse butterfly and bird populations that play crucial roles in pollination, pest control, and nutrient cycling.

Currently, the road to the temple is in a dilapidated condition with a width of only 3.5 meters. The proposed construction aims to widen it to 8.5 meters to improve accessibility. However, petitioners had raised alarms about potential encroachment or alteration of temple property and the Madayipara landscape, seeking directives for the Malabar Devaswom Board to protect the temple property, ponds, natural water bodies, and ecological features.

Stringent Green Protocol Mandated by the Court

In its detailed order, the court emphasized that the road widening must proceed without causing any damage or disturbance to the biodiversity of Madayipara, including its ponds, water bodies, and existing natural flora and fauna. To mitigate environmental impact, the court has imposed a comprehensive green protocol.

Key directives include:

  • Afforestation with not less than 400 trees, consisting of species indigenous to and compatible with the geographical and ecological features of the locality.
  • Planting to be carried out at appropriate locations in consultation with the divisional forest officer, with completion targeted by June.
  • Video records of all afforestation activities must be maintained by the Public Works Department (PWD) contractor and submitted to the court by July 15.
  • The executive officer of the temple and the Sree Madayi trustee Chirackal Kovilakam Devaswom are tasked with ensuring proper and regular watering of the newly planted trees.

Additionally, the court has directed the principal chief conservator of forests to formulate and finalize a comprehensive afforestation scheme covering a larger extent of Madayipara. This scheme must be presented before the court on or before July 15, with the petition adjourned to July 16 for further review.
