A sessions court in Visavadar, Gujarat, has delivered a landmark verdict, sentencing 20-year-old Shahrukh Sheikh to rigorous life imprisonment for the abduction and rape of a 16-year-old girl. The court mandated that Sheikh must serve his sentence for the remainder of his natural life, emphasizing the gravity of the crime committed against a minor.

Details of the Abduction and Crime

On April 15, 2024, Sheikh, a resident of Mandiya village in Visavadar taluka, lured the 15-year-old victim away from her home. The two had initially connected and communicated through Instagram and text messages, where Sheikh convinced the minor to elope with him. This manipulation led to the tragic sequence of events that followed.

The accused transported the young girl from her village to Junagadh, where they boarded a private luxury sleeper bus destined for Ahmedabad. During the journey, Sheikh forcibly assaulted the minor on a sleeper seat, committing the heinous act of rape while the bus was in motion.

Investigation and Arrest

The girl's father, upon discovering her disappearance, searched for her for two days before filing a formal complaint at the Visavadar police station on April 17, 2024. Meanwhile, Sheikh and the victim had spent two days in Ahmedabad. The investigating officers diligently tracked them down and successfully brought them back from Ahmedabad, ensuring the accused was apprehended.

Court Proceedings and Legal Arguments

During the trial, the defense attempted to argue that the minor had left her home voluntarily and that the physical relationship was consensual. However, the court vehemently rejected this defense. Relying on the Protection of Children from Sexual Offences (POCSO) Act and relevant Supreme Court precedents, the court firmly observed that the consent of a minor under 18 years of age is legally invalid and cannot be used as a defense in such cases.

The prosecution, led by assistant public prosecutor V N Madhak, built a robust case supported by multiple pieces of evidence. This included the compelling testimony of the victim, her father, the medical officer, and investigating officials, all corroborated by medical and forensic evidence that left no room for doubt.

Verdict and Sentencing

Delivering the verdict on March 30, additional sessions Judge H V Joshi found Sheikh guilty under multiple sections of the law. He was convicted under Sections 363, 366, and 376(3) of the Indian Penal Code (IPC), as well as Sections 4 and 6 of the POCSO Act.

In addition to the life imprisonment sentence, which mandates incarceration until his death, the court also imposed a fine of Rs 70,000 on Sheikh. This verdict underscores the judiciary's commitment to protecting minors and delivering justice in cases of sexual violence, sending a strong message against such crimes.
