In a significant ruling upholding consumer rights, the district consumer disputes redressal commission in Ludhiana has mandated a retail store chain to provide compensation of Rs 10,000 to a customer. This decision comes after the store allegedly refused to exchange a backpack that was purchased, despite prior assurances. The commission has also ordered the store to refund the original invoice amount of Rs 899 to the complainant, Hardip Singh, a resident of Gondwal village in Ludhiana district, within 30 days from receiving the returned product.

Details of the Complaint and Alleged Deficiency in Service

According to the complaint filed, Hardip Singh bought a backpack for his son from the store on August 30, 2023. He asserted that at the time of sale, the store had guaranteed him that the product could be exchanged within 14 days of purchase, with these exchange conditions clearly printed on the backside of the invoice. On September 1, 2023, Singh visited the store to exchange the bag for a different color, but he alleged that the store declined his request, contradicting the agreed-upon terms.

Singh reported that he made repeated attempts to have the exchange processed, but each time, the store denied his plea. On September 2, 2023, he escalated the matter by sending an email to the company's customer service department, seeking the exchange as per the invoice conditions within the stipulated timeframe. However, he received no response, leading him to claim that he endured mental anguish, harassment, and inconvenience due to what he described as a deficiency in service by the store. In his formal complaint, Singh demanded a refund of Rs 899 with 12% annual interest from the purchase date, compensation of Rs 50,000, and Rs 11,000 for litigation expenses.

Store's Defense and Commission's Observations

Upon receiving the notice from the commission, a representative from the store appeared and submitted a written statement in defense. The store argued that the product could only be replaced by the manufacturer, who had not been included as a party in the case by the complainant. They cited their terms and conditions, emphasizing that the original invoice, product tags, and warranty card were essential for any return or exchange. Furthermore, the store pointed out that all exchange and return processes were to be handled exclusively by the manufacturer, not by the store under any circumstances.

During the legal proceedings, the complainant submitted his affidavit along with supporting documents, reiterating his allegations. In contrast, the opposite party failed to produce any evidence in its defense, despite the commission granting multiple opportunities, including a final chance with an imposed cost of Rs 500 for non-compliance.

Commission's Ruling and Directives

The commission noted that since the store had not submitted any evidence, the complainant's assertions remained unchallenged and unrebutted. After thoroughly examining the available material, the commission concluded that it was appropriate to direct the complainant to return the backpack within 15 days of receiving the order. Additionally, it mandated the store to refund the Rs 899 invoice value within 30 days from the date it receives the product back from the complainant.

Beyond the refund, the commission ordered the store to pay a composite compensation of Rs 10,000 to Hardip Singh. This ruling underscores the importance of adhering to consumer protection laws and honoring service commitments, serving as a reminder to retailers about their responsibilities towards customers.
