Madras High Court Demands Comprehensive Safety Report After Deadly Fireworks Blast

The Madras High Court has issued a stern directive to the Tamil Nadu state government, demanding a detailed report containing concrete suggestions to prevent recurring accidents in fireworks manufacturing units. This judicial intervention comes in the direct aftermath of a devastating explosion at a fireworks factory in Kattanarpatti village, Virudhunagar district, on April 19, which tragically claimed the lives of 25 individuals.

Judges Express Grave Concern Over Monthly Casualties

A division bench comprising Justice N Sathish Kumar and Justice M Jothiraman made strong oral observations during the hearing. The judges expressed profound dismay, noting that it is "very unfortunate" that such fatal incidents are reported almost every month, with a significant number of the victims being women workers.

  1. Mandatory High-Value Insurance: The court stated that workers engaged in such hazardous occupations must have adequate life insurance coverage of more than ₹25 lakh. The judges were clear that employment should only be permitted once this insurance is secured for all personnel.
  2. Seasonal Production Halts: Recognizing that extreme summer heat could be a contributing factor to explosions, the bench suggested exploring the possibility of temporarily suspending production activities during the peak summer season as a preventive measure.

Advocates and State Government Submissions

During the proceedings, several advocates presented arguments highlighting systemic failures. They contended that these recurring tragedies are primarily due to lapses by regulatory authorities who fail to properly monitor the fireworks units. Many of these facilities allegedly operate with numerous safety violations that go unchecked.

The state government, represented by its counsel, submitted that it has provided an ex-gratia payment of ₹5 lakh to each family of the deceased workers. Furthermore, the government assured the court that it is actively working on formulating substantive suggestions and an action plan to prevent such accidents from happening repeatedly in the future.

Court Sets Deadline for Action

The Madras High Court has given clear instructions for moving forward. The judges have asked the advocates involved in the case to formally file their written suggestions regarding safety improvements. Simultaneously, the state government must compile and submit its detailed report outlining proposed preventive measures.

The court has scheduled the next hearing on this critical matter for June 8, by which time all reports and suggestions are expected to be submitted for judicial review. This case underscores the urgent need for enhanced industrial safety protocols in hazardous sectors like fireworks manufacturing to protect vulnerable workers.
