Pune Court Convicts Barber for Sexual Assault of Minor Boy

In a significant ruling, the court of additional sessions judge (POCSO Act) SS Saste in Pune on Thursday convicted and sentenced a 24-year-old barber to five years of rigorous imprisonment. The conviction pertains to the sexual assault of a seven-year-old boy that occurred in a room inside the accused's shop in the Vimantal police area on November 7, 2022.

Legal Proceedings and Custody Details

The accused, who had been granted bail three months after his arrest on November 10, 2022, was taken into custody immediately following the pronouncement of the judgment. Special Public Prosecutor Nitin Konghe confirmed that the barber was sent to jail to serve his sentence, underscoring the swift enforcement of the court's decision.

Court's Assessment of Evidence

The court found the evidence presented by the boy, his mother, and his father, who filed the complaint, to be consistent and highly reliable. It emphasized that the boy's testimony was credible and did not appear to be influenced or coached. Furthermore, the court noted that there was no necessity to examine an independent witness, as the crime took place within the confined space of a room in the shop, making external observation unlikely.

Dismissal of Defence Arguments

The defence argued that the accused had been falsely implicated due to a minor injury caused accidentally while cutting the boy's hair. However, the court rejected this claim, pointing out that the complainant did not mention any such injury, as it was considered trivial and not worth noting. The court also reasoned that no family would jeopardize their child's and their own reputation by fabricating such a serious allegation.

Focus on Psychological Impact

In its observations, the court highlighted the profound psychological impact of such offences on children, stating that the absence of visible injuries does not diminish the trauma experienced by the victim. It remarked, "The victim has to suffer agony at too small an age," reinforcing the need for stringent penalties in cases of child sexual abuse.
