Pune IT Professional Receives 25-Year Sentence for Heinous Crimes Against Minor Niece
A sessions court in Pune has delivered a landmark verdict, convicting and sentencing a 41-year-old application development team leader from a prominent Hinjewadi IT company to 25 years of rigorous imprisonment. The individual was found guilty of repeatedly raping his 12-year-old niece over a prolonged period of three years, with the final incident occurring before May 11, 2021.
Heartbreaking Background of the Survivor
The minor survivor had been living with her maternal aunt and the convict, who was her aunt's husband, following a tragic family history. Her father had murdered her mother and was subsequently incarcerated, leaving the child in the care of relatives who betrayed her trust in the most horrific manner.
Court's Stern Judgment Under POCSO Act
Special Judge HM Bhosale, delivering the verdict on April 8, found the IT engineer guilty under sections 5(I) and 6 of the Protection of Children from Sexual Offences (POCSO) Act. These sections specifically address aggravated penetrative sexual assault committed by individuals in positions of authority or family members. The prescribed minimum sentence for such crimes is 20 years, which can extend to life imprisonment or even the death penalty.
The judge emphasized the severity of the crime, stating: "The act of rape committed in the present case, as reflected from the video evidence, is so heinous and reprehensible that it shocks the conscience of the common man. Such a barbaric act strikes at the very core of societal values."
How the Crime Was Uncovered
The case came to light on May 10, 2021, when the convict's wife, growing suspicious of his activities, placed her cellphone camera in video recording mode within the room where the assaults occurred. Upon returning, she discovered the entire act had been captured on video. She immediately arranged for the girl's medical examination and filed an official complaint on May 11, 2021, leading to the IT engineer's arrest the same day. He has remained in custody since that date.
Evidentiary Strength Secures Conviction
Despite the complainant being declared hostile during the trial and not supporting the rape allegations, the prosecution built an ironclad case. Special prosecutor Arundhati Brahme presented compelling evidence including:
- The crucial video recording admitted by the complainant
- "Confidence inspiring and reliable" testimony from the rape survivor
- Corroborating medical and DNA evidence
- Expert analysis from chemical examination specialists
This comprehensive evidence proved decisive in securing the conviction.
Additional Charges and Court's Clarification
The Hinjewadi police had initially invoked gang rape charges based on the survivor's allegation that her maternal aunt's minor brother had witnessed the convict sexually exploiting her and had subsequently taken advantage of the situation to rape her on two to three occasions.
However, the court dismissed the gang rape charge, clarifying that the prosecution's case did not establish that "the accused (IT engineer) and the boy sexually exploited the survivor in furtherance of a common intention to commit gang rape." The judge noted that allegations against the minor boy related to separate incidents and directed the investigating officer to take appropriate steps for his arrest and prosecution before the relevant juvenile authorities.
Lasting Trauma and Judicial Denunciation
In his judgment, Judge Bhosale highlighted the profound impact on the survivor: "The trauma suffered by the victim is immeasurable and has left a lasting scar on her psyche. The act has caused irreparable harm to her physical, mental and emotional well-being. The innocence of the victim has been brutally violated. The accused exploited the vulnerability and helplessness of a minor child."
The court firmly concluded that the convict deserved no leniency in punishment, given the gravity of his crimes and their devastating impact on the young survivor.
