The Supreme Court, however, found that the suit was clearly barred by Article 54 of the Limitation Act, 1963, which prescribes a period of three years for specific performance from the date fixed for performance or, if no date is fixed, when the plaintiff has notice that performance is refused. The bench noted that the agreement did not specify a date for performance, and the plaintiff had not shown any refusal within the limitation period. "The suit is ex-facie barred by limitation. The courts below erred in law by not exercising their power under Order VII Rule 11(d) of the Code of Civil Procedure," the bench observed.
