Supreme Court Agrees to Hear Urgent Petition for CBI Investigation in Gurugram Child Rape Case
In a significant development, the Supreme Court of India has agreed to hear a petition on Monday, March 23, 2026, seeking a Central Bureau of Investigation (CBI) or Special Investigation Team (SIT) probe into the horrific rape of a four-year-old girl in Gurugram. The decision came after senior advocate Mukul Rohatgi urgently mentioned the case before a three-judge Bench led by Chief Justice Surya Kant.
Allegations of Police Inaction and Urgent Legal Intervention
During the hearing, Rohatgi highlighted severe lapses by the Gurugram Police, stating that no arrests have been made despite the victim providing a detailed statement to a magistrate. He emphasized that the crime scene remains unsecured, CCTV footage has not been collected, and household maids are suspected to be involved in the incident. "The Gurugram Police have done nothing despite the girl giving a statement to the magistrate detailing the horrific incident," Rohatgi told the Bench, which also included Justice Joymalya Bagchi and Justice Vipul M Pancholi.
Supreme Court's Initial Response and Subsequent Agreement
Initially, Chief Justice Surya Kant advised the petitioners to approach the Punjab and Haryana High Court. However, after Rohatgi argued that the high court is located in Chandigarh while the victim's father works in Gurugram, making access difficult, the Supreme Court agreed to take up the petition. Rohatgi stressed the need for a strong message from the highest court, saying, "A message should go from the highest court of the country in this horrific case." He insisted that the investigation be transferred to the CBI or another agency to ensure impartiality and efficiency.
