The State Human Rights Commission (SHRC) of Kerala, chaired by Justice Alexander Thomas, has issued a directive to take strict disciplinary action against police officers who compel accused individuals detained in police station lockups to remain dressed only in their undergarments. The commission has also instructed the state police chief to ensure that existing guidelines from police headquarters on this matter are rigorously followed across all police stations in the state.
Complaint and Proceedings
The action was initiated following a complaint filed by R G Leninraj, a resident of Amaravila, who alleged that forcing detainees to stay in lockups wearing only undergarments constitutes a violation of their human rights and fundamental rights guaranteed under the Constitution. The SHRC sought a detailed report from the Additional Director General of Police (Law and Order) regarding the practice.
Police Report and Instructions
According to the report submitted to the commission, police headquarters had already issued clear instructions stating that police personnel must not engage in any act that violates the human rights or fundamental rights of accused persons. The report further emphasized that strict disciplinary action would be initiated against any officer found acting in violation of these directives. The SHRC has now directed that these instructions be implemented with full force across the state to prevent any recurrence of such practices.
The commission's order underscores the importance of upholding the dignity of individuals in custody and ensuring that law enforcement procedures comply with constitutional and human rights standards.
