Telangana High Court Upholds Legality of Kaleshwaram Probe Commission
The Telangana High Court delivered a significant verdict on Wednesday, affirming that the PC Ghose Commission established by the state government to investigate alleged irregularities in the Kaleshwaram project is neither illegal nor arbitrary. This ruling validates the commission's inquiry process, marking a crucial development in the ongoing scrutiny of the multi-crore irrigation initiative.
Court Finds Commission Findings Prejudicial and Unjust
However, the bench comprising Chief Justice Aparesh Kumar Singh and Justice GM Mohiuddin identified serious flaws in the commission's conclusions. The judges determined that the findings adversely impact the conduct and reputation of the petitioners and contravene principles of natural justice along with statutory safeguards. Consequently, the court extended protection to the petitioners, shielding them from any punitive measures based on these inquiry results.
"The findings shall be inoperative and no action can be taken on the basis thereof," declared Chief Justice Aparesh Kumar Singh while dictating the order. This directive effectively nullifies the commission's conclusions, rendering them legally unenforceable against the individuals involved.
Petitions Partially Allowed After Extensive Hearings
The bench issued this order while disposing of petitions filed by prominent figures, including former Chief Minister and BRS chief K Chandrashekar Rao, former minister and BRS senior leader T Harish Rao, senior IAS officer Smita Sabharwal, and former Chief Secretary Shailendra Kumar Joshi. The legal proceedings spanned approximately seven months, featuring marathon arguments from both the petitioners' counsel and state representatives.
The court's decision to partially allow the petitions underscores a balanced approach: it upholds the government's right to constitute an inquiry commission while safeguarding individuals from prejudicial outcomes that lack procedural fairness. This ruling highlights the judiciary's role in ensuring accountability mechanisms adhere to legal standards and protect fundamental rights.
