Uttarakhand High Court Grants Relief to Candidates in PCS (J) Exam Dispute

In a significant ruling, the Uttarakhand High Court has permitted two candidates to participate in the PCS (J) main examination, following their legal challenge against exclusion from a revised merit list. The decision underscores judicial intervention in competitive exam processes.

Background of the Case

Anushka Bhandari and Anushree Khatri, who had appeared for the PCS (J) preliminary examination conducted by the Uttarakhand Public Service Commission, were initially listed as successful candidates. However, after certain individuals raised concerns about flaws in some preliminary exam questions, the commission released a revised merit list. In this updated list, both candidates were excluded by a narrow margin of just a few marks, prompting them to file a petition in court.

Court Hearing and Legal Precedent

During a hearing on Monday before a division bench comprising Justices Manoj Kumar Tiwari and Siddhartha Sah, the candidates' counsel referenced a Supreme Court of India order from the case of 'Harikishan vs Rajasthan'. This ruling established that once a candidate is declared successful in a competitive preliminary examination, they cannot be subsequently excluded from the process. Relying on this precedent, the Uttarakhand High Court granted permission for both candidates to appear in the main examination, which is scheduled for April 21.
