CPM Challenges Election Commission Over Voter List Deadline
The Communist Party of India (Marxist) state secretariat has issued a strong demand to the Election Commission (EC), urging it to ensure that applications for inclusion in the voters' list can be submitted until the last day of nomination paper submission for upcoming elections. This call comes in response to an EC press release that set a March 15 cutoff, which the CPM argues infringes on the constitutional right to vote and could disenfranchise lakhs of citizens.
Constitutional and Legal Concerns Raised
In a detailed statement, the CPM highlighted that Section 23 of the Representation of the People Act, 1950 explicitly permits citizens to be added to the voters' list up to the nomination deadline. The party pointed out that during an all-party meeting related to election preparations, EC officials had assured participants that this opportunity would be available until that date. However, the recent press release contradicts this assurance, creating confusion and potential injustice.
The EC has a responsibility to inform the public well in advance about the final date for adding voters in assembly elections, the CPM emphasized. Announcing such critical information a week after the determined final date is deemed unjust and undermines democratic processes.
Impact of Special Intensive Revision
The CPM also raised concerns about the Special Intensive Revision (SIR) process, which has led to the removal of lakhs of names from the voters' list without a proportional addition of new registrants. This imbalance, coupled with the EC's deadline, could result in the exclusion of thousands of eligible voters, despite legal provisions allowing for their inclusion.
EC, which should encourage the maximum number of people to exercise their voting rights, is acting contrary to this principle, the statement added. The party has called for the immediate withdrawal of this move to safeguard democratic integrity.
