Supreme Court Refuses to Defer Hearing on CJI's Exclusion from CEC Panel
SC Won't Defer Hearing on CJI's Exclusion from CEC Panel

The Supreme Court on Wednesday refused to defer the hearing on petitions challenging the exclusion of the Chief Justice of India (CJI) from the panel responsible for selecting the Chief Election Commissioner (CEC). The bench, led by Justice Surya Kant, stated that the matter was of utmost importance and could not be postponed.

Court's Firm Stance

“This matter is more important,” the bench remarked, dismissing requests to adjourn the proceedings. The court was hearing a batch of petitions that question the constitutional validity of the law that removed the CJI from the selection committee for the CEC and Election Commissioners.

Background of the Case

Earlier on March 20, CJI Surya Kant had recused himself from hearing the petitions, leading to the formation of a new bench. The petitioners argue that the exclusion undermines the independence of the Election Commission, a key constitutional body.

The government, however, defended the law, stating that it ensures a broader representation in the selection process. The Supreme Court is expected to deliver a significant verdict on the matter, which could impact the functioning of the Election Commission.

The next hearing is scheduled for next week, where detailed arguments will be presented by both sides.
