Speaker to Rule on Defection Cases Before Monsoon Session
Lok Sabha Speaker Om Birla is set to deliver decisions on defection petitions involving the Trinamool Congress (TMC) and the Shiv Sena (UBT) before the commencement of the Monsoon session of Parliament. The Speaker personally met and heard a TMC delegation led by Abhishek Banerjee, as well as representatives from the breakaway faction, to understand the rival claims. A similar exercise was conducted for the Shiv Sena (UBT) faction, where the Speaker listened to arguments from both sides.
TMC Delegation Led by Abhishek Banerjee Heard
In the TMC case, the Speaker's intervention follows a split in the party, with a group of MLAs breaking away from the parent party. The TMC delegation, headed by national general secretary Abhishek Banerjee, presented their case before the Speaker, arguing that the breakaway group's actions amount to defection under the anti-defection law. The rebel faction also submitted its response, claiming they represent the true party. The Speaker's decision will determine which group is entitled to the party's name and symbol in the Lok Sabha.
Shiv Sena (UBT) Faction Also Heard
Similarly, in the Shiv Sena (UBT) matter, the Speaker heard the Uddhav Thackeray-led faction and the rival Eknath Shinde group. The UBT faction has sought disqualification of certain MLAs who aligned with the Shinde camp, alleging they voluntarily gave up party membership. The Shinde faction, on the other hand, argues that they constitute the real Shiv Sena. The Speaker's ruling will have significant implications for the balance of power in the Lok Sabha, as both sides claim the support of the party's elected members.
Decisions Expected Before Monsoon Session
The Monsoon session of Parliament is scheduled to begin later this month, and the Speaker aims to clear these pending defection cases to avoid disruptions during the session. According to sources, the Speaker has completed the hearing process and is now deliberating on the evidence and submissions. The decisions are expected to be announced in the coming days, potentially impacting the strength of the ruling coalition and the opposition.
Background of the Defection Cases
The TMC and Shiv Sena (UBT) defection cases are among several pending before the Speaker. In the TMC, a group of MLAs led by Mukul Roy had rebelled against the party leadership, leading to a split. The Speaker's ruling will decide the legitimacy of the breakaway group's claim to the party name. In the Shiv Sena, the split occurred after Eknath Shinde led a rebellion against Uddhav Thackeray, resulting in a change of government in Maharashtra. The Speaker's decision on the Lok Sabha members will set a precedent for similar cases in other states.
According to a statement from the Speaker's office, the decisions will be based on the provisions of the Tenth Schedule of the Constitution, which deals with anti-defection. The Speaker has taken into account the submissions of all parties and will issue a reasoned order. The outcome is keenly awaited by political analysts and party workers alike.
