Congress Legal Team Prepares Bail Petition for Pawan Khera in Assam Forgery Case

The Assam Pradesh Congress Committee's (APCC) legal cell is set to file a crucial bail petition on behalf of All India Congress Committee (AICC) media and publicity chairperson Pawan Khera. The petition will be presented before the Gauhati High Court in connection with a serious case involving allegations of forgery and criminal conspiracy. This case was formally registered by Riniki Bhuyan Sharma, who is the wife of Assam Chief Minister Himanta Biswa Sarma.

Background of the Legal Dispute and Allegations

The legal proceedings originated when Riniki Bhuyan Sharma filed an official complaint at the Crime Branch Police Station under the Guwahati Police Commissionerate. This filing occurred during the late hours of April 6, shortly after Pawan Khera made public accusations against her. Khera had alleged that Riniki Sharma possesses passports from multiple foreign nations, specifically the United Arab Emirates, Egypt, and Antigua and Barbuda. Furthermore, he claimed that the Sarma family operates a limited liability company based in the United States.

Legal Strategy and Court Proceedings

Advocate Aman Wadud, who is leading the APCC's legal team alongside advocate Reetam Singh, confirmed that the bail plea will be submitted to the Gauhati High Court on Monday. Wadud explained that the filing was delayed due to the court's closure for the Bohag Bihu vacation period. The legal team is now mobilizing to present their arguments for Khera's bail in this high-profile case.

In a related development, an Assam Police team led by Deputy Commissioner of Police (Crime) Debajit Nath conducted a coordinated search operation at Pawan Khera's residence in Delhi on April 7. This operation was executed with the assistance of Delhi Police authorities. However, Khera was not present at the location during the search. DCP Nath stated that law enforcement agencies are committed to tracing Khera's whereabouts wherever he may be.

Judicial Interventions and Supreme Court Ruling

Pawan Khera initially sought legal protection through a transit anticipatory bail application filed before the Telangana High Court on April 7. On April 10, Justice K Sujana of the Telangana High Court granted him transit anticipatory bail for a period of one week. This bail was granted subject to specific conditions, including the requirement that Khera must approach the Gauhati High Court for appropriate legal relief regarding the Assam case.

The Assam government subsequently challenged this Telangana High Court order in the Supreme Court. On April 15, the Supreme Court issued a stay on the Telangana High Court's bail order, characterizing Khera's legal approach as "forum-shopping." The Supreme Court further reinforced its position on April 17 by refusing to extend the bail period or vacate the stay. The court explicitly directed Pawan Khera to approach the Gauhati High Court immediately to seek relief in the ongoing case.

Nature of Charges and Legal Framework

The case registered at the Guwahati Crime Branch Police Station encompasses multiple serious charges under the Bharatiya Nyaya Sanhita (BNS), 2023. These charges include making false statements during elections, cheating, forgery of documents, and insult through public statements. The legal proceedings represent a significant development in the political landscape of Assam, involving prominent political figures and complex legal interpretations.

The APCC legal team's upcoming bail petition before the Gauhati High Court marks a critical juncture in this ongoing legal battle. All parties involved await the court's decision regarding Khera's bail application as the case continues to unfold through India's judicial system.
