Maharashtra Government Approves Landmark Regularization Scheme for Pre-2011 Encroachments
The Maharashtra government has taken a significant step toward housing security by approving the regularization of residential encroachments on government land that have existed since January 1, 2011, or earlier. This initiative, announced by Revenue Minister Chandrashekhar Bawankule, aims to provide shelter to lakhs of low-income families across the state, with the notable exclusion of Mumbai and Mumbai Suburban districts.
Key Provisions of the Regularization Scheme
Under the newly approved scheme, encroachments up to 500 square feet will be regularized free of cost, offering substantial relief to eligible families. For areas beyond 500 sq ft, an occupancy fee of 10% of the prevailing market value will be applied, with a maximum eligible area capped at 1,500 sq ft. Any construction exceeding this limit will be subject to removal to ensure compliance with the regulations.
Structures with partial commercial use will face a higher charge of 25% of the market value for the commercial portion, reflecting the government's focus on residential regularization. The land will be granted jointly in the names of the husband and wife under the "occupancy class-II" category, promoting gender inclusivity in property ownership.
Eligibility Criteria and Implementation Framework
To qualify for regularization, applicants must provide proof of residence before January 1, 2011, using documents such as voter lists, electricity bills, or property tax receipts. Additionally, evidence of continuous residence over the past year is required to ensure genuine occupancy. The government has mandated strict scrutiny to exclude non-citizens from benefiting from the scheme.
Encroachments on ecologically or socially sensitive land will not be regularized, including areas such as riverbeds, grazing lands, forests, public roads, cremation grounds, playgrounds, and land reserved for schools and hospitals. Eligible families in these locations will instead be considered for alternative housing under the Pradhan Mantri Awas Yojana, ensuring they are not left without shelter.
Administrative Oversight and Registration Details
Implementation of the scheme will be overseen by a multi-tier committee structure:
- District-level committees led by guardian ministers, comprising 17 members.
- Sub-committees at the constituency level to facilitate local coordination.
- Operational oversight by district collectors, sub-divisional officers, and tehsildars.
The registration fee for plots up to 1,000 sq ft has been set at Rs 1,000, making the process affordable for low-income households. Revenue Minister Bawankule emphasized the government's firm stand that no needy family in Maharashtra should remain without shelter, with progress reviews scheduled every three months to ensure effective execution.
This comprehensive approach aims to balance housing security with environmental and social sensitivities, providing a structured pathway for regularization while safeguarding public resources.
