A motor accident victim from Ludhiana, who was confined to a wheelchair after losing both his legs in a road accident in 2019, has been awarded a compensation of Rs 25 lakh by the Motor Accidents Claims Tribunal. The tribunal, presided over by Judge Harpreet Kaur, directed the insurance company to pay the amount with interest at 9% per annum from the date of filing the claim petition.
Details of the Accident
The petitioner, identified as 32-year-old Ravi Kumar, a resident of Haibowal, was riding a motorcycle on April 15, 2019, when a speeding car hit him near the Gill Road crossing. The impact threw him off the bike, and he sustained severe injuries to his legs. Despite multiple surgeries, doctors could not save his limbs, and both his legs had to be amputated above the knee. Since then, Ravi has been dependent on a wheelchair for mobility.
Claim and Tribunal Ruling
Ravi filed a claim petition before the Motor Accidents Claims Tribunal, seeking compensation for the loss of his limbs, medical expenses, and loss of earning capacity. The insurance company contested the claim, arguing that the accident occurred due to Ravi's own negligence. However, the tribunal, after examining the evidence, held the car driver responsible for the accident.
In its order, the tribunal stated, "The petitioner has suffered permanent disability of 100% and has lost both his legs. He cannot walk or stand and is confined to a wheelchair for the rest of his life. The compensation of Rs 25 lakh is just and fair to meet his medical expenses, loss of income, and pain and suffering."
Compensation Breakdown
The tribunal awarded the following amounts under different heads:
- Loss of earning capacity: Rs 12 lakh
- Pain and suffering: Rs 5 lakh
- Medical expenses: Rs 4 lakh
- Conveyance and special diet: Rs 2 lakh
- Loss of amenities: Rs 2 lakh
The tribunal also directed the insurance company to deposit the amount within 30 days, failing which interest at 12% per annum would be applicable.
Reaction of the Victim
Speaking to the media, Ravi Kumar expressed relief at the verdict. "The accident destroyed my life. I cannot work or support my family. This compensation will help me manage my medical expenses and provide some support to my family. I am grateful to the court for recognizing my suffering," he said.
Ravi's lawyer, Advocate Sunil Sharma, said the judgment set a precedent for similar cases. "The tribunal rightly held the driver and insurance company liable. The compensation will help the victim lead a dignified life despite his disability," the lawyer added.
The insurance company has the option to appeal the order before a higher court.
