A Chinese court has ruled that companies cannot terminate employees simply to replace them with artificial intelligence systems, as authorities navigate the dual priorities of stabilizing the domestic labor market and competing in the global AI race.
Court Decision on Unfair Dismissal
The Hangzhou Intermediate People's Court decided that a tech firm in eastern China had illegally fired a worker who refused a demotion after his job was automated by AI. According to a court statement dated April 28, the company's grounds for termination did not qualify as legitimate reasons such as business downsizing or operational difficulties. The court emphasized that the situation did not meet the legal condition of making it 'impossible to continue the employment contract.'
Technological Progress Not a Justification
In a separate statement, the court clarified that companies cannot unilaterally lay off employees or reduce salaries due to technological advancements. This ruling sets a precedent for balancing innovation with worker protections.
Broader Context of AI Adoption
Chinese firms are rapidly adopting AI systems as part of a state-led initiative to dominate the technology sector. However, the Chinese Communist Party has also signaled a commitment to labor market stability amid a slowing economy and high youth unemployment. This ruling reflects the tension between fostering technological progress and ensuring social stability.
