US Labor Department Ramps Up H-1B Visa Investigations Amid Rising Caseload
The US Labor Department has significantly escalated its scrutiny of employers utilizing the H-1B visa program to hire foreign workers, according to a report by Bloomberg. Data reveals a substantial 48% increase in the department's caseload of H-1B investigations since the launch of Project Firewall, an initiative designed to combat abuse of the visa system.
Project Firewall and Enhanced Enforcement Measures
Project Firewall was introduced last year with the primary objective of safeguarding the rights, wages, and job opportunities of American workers by preventing misuse of the H-1B program. As part of this effort, the Labor Department is conducting more frequent site visits to employers, where officials pose complex, technical questions to assess compliance.
Immigration attorney Kevin Andrews highlighted that investigators are now focusing on hyper-technical violations, moving beyond traditional concerns like drugs and criminal activities. The department is also leveraging artificial intelligence to identify potential loopholes and inconsistencies in visa applications.
Site Visits and Scrutiny of Employer Records
Another immigration attorney, Nandini Nair, reported to Bloomberg that some companies are experiencing site visits every time they submit a new H-1B petition. During these visits, officials initially request detailed information about the specific candidate named in the petition but subsequently demand immigration and payroll records for all employees.
Attorney Brian Coughlin explained that responses provided during site visits are meticulously compared against the information submitted in the original petitions. Any discrepancies can trigger red flags for the government, potentially leading to further investigation or penalties.
"No one can be prepared for it other than to understand that they shouldn’t just casually answer questions when it comes to minimum requirements or really anything else," Coughlin advised. "It’s better to slow it down and look at the filing that was submitted to make sure that the government’s getting the correct information and a consistent message."
Changes to the H-1B Lottery and Application Process
This year marks a pivotal shift in the H-1B lottery system, transitioning from a random selection process to a wage-based model. Additionally, the US Citizenship and Immigration Services (USCIS) has revised its Form I-129 to include more detailed inquiries about job requirements, such as education levels, years of experience, technical skills, and supervisory roles.
