West Bengal Hospitals Ordered to Pay Rs 3 Lakh Compensation for Ultrasound Delay Leading to Abortion
The West Bengal Clinical Regulatory Establishment Commission (WBCREC) has mandated two private hospitals in Kolkata to provide a substantial compensation of Rs 3 lakh to a woman who was compelled to undergo an abortion due to a critical delay in conducting a transvaginal ultrasound (TVS) procedure. This decision underscores the severe consequences of medical negligence in emergency healthcare situations.
Details of the Medical Negligence Case
According to the official complaint filed with the commission, the patient, who works as a nurse, initially sought emergency medical attention at Bhagirathi Neotia Hospital after experiencing profuse vaginal bleeding. The emergency doctors at the facility promptly advised a transvaginal ultrasound to assess her condition. However, the hospital informed her that the radiologist required at least 45 minutes to arrive at the premises, causing an unacceptable delay in critical care.
Unwilling to wait for such an extended period, her husband contacted CMRI Hospital to confirm the availability of the necessary test. Upon receiving assurance, they immediately transferred to the second hospital. Unfortunately, at CMRI, the situation did not improve significantly. Although the patient was examined by a gynaecologist and a standard ultrasound (USG) was performed, the crucial TVS procedure was still not conducted even after a lapse of three hours.
This persistent failure forced the couple to seek treatment at a third facility, Woodlands Hospital, where the transvaginal ultrasound was finally administered. However, by this time, the prolonged delay had resulted in irreversible complications, necessitating the abortion of the foetus to safeguard the mother's health.
Commission's Ruling and Compensation Breakdown
In response to this grave incident, Justice (retd) Asim Kumar Banerjee, the chairman of the West Bengal Clinical Regulatory Establishment Commission, announced the compensation orders. The commission has directed Bhagirathi Neotia Hospital to pay Rs 1 lakh and CMRI Hospital to pay Rs 2 lakh to the affected patient. This ruling highlights the accountability of healthcare institutions in providing timely and adequate medical services, especially in emergencies.
The case brings to light the urgent need for hospitals to streamline their emergency response protocols and ensure the availability of essential diagnostic services without undue delays.
