Charge Sheet Filed in Chandigarh Court Against Telangana Resident

The Chandigarh Police have filed a charge sheet against Hassan Mohiuddin Siddiqi, a resident of Hyderabad, Telangana, in connection with a case involving the circulation of an obscene and misleading video. The charge sheet was presented before a local court, which has accepted it, marking a significant step in the legal proceedings. Siddiqi was arrested on April 25 following a complaint filed by a city-based advocate, who alleged that the accused was part of a conspiracy to defame the head of the government of India.

Details of the FIR and Allegations

The FIR was registered by the Chandigarh Police on April 19 under multiple sections of the Bharatiya Nyaya Sanhita (BNS) 2023 and the Information and Technology Act, 2000. Specifically, the charges include Sections 196, 356, 336(4), 353, 336(1), 336(3), 340, and 318 of the BNS-2023, as well as Sections 66-C, 66D, and 67 of the IT Act. These provisions address promoting enmity between groups, forgery, criminal defamation, and digital manipulation.

The complainant, an advocate from Chandigarh, alleged that author Madhu Kishwar and certain other social media users circulated forged and misleading posts, along with obscene video content, targeting the head of the Government of India. The intention, according to the FIR, was to damage his dignity and reputation. The accused, Hassan Mohiuddin Siddiqi, was specifically accused of circulating and disseminating misleading and scandalous information through his X (formerly Twitter) account, acting in criminal conspiracy with others.

Investigation and Arrest

During the course of the investigation, the police found that the accused had engaged in digital manipulations, satisfying the ingredients of forgery. The police alleged that the act had a serious tendency to promote disharmony between religious and regional groups, as well as between different castes and communities, and was likely to cause public mischief. Based on these findings, Siddiqi was arrested on April 25. The Chandigarh court had earlier dismissed the anticipatory bail application of prominent writer Madhu Kishwar in the same case, indicating the seriousness of the allegations.

Legal Proceedings and Next Steps

With the filing of the charge sheet, the court will now proceed with the trial. The accused remains in custody as the legal process moves forward. The case highlights the increasing use of social media platforms for spreading misinformation and the legal consequences under Indian law. The Chandigarh Police have emphasized the need for stringent action against those who misuse digital platforms to spread obscene and defamatory content, particularly when aimed at high-ranking officials.
