A Delhi court has scheduled daily hearings from July 27 to August 7 to frame charges against Aam Aadmi Party (AAP) leader Naresh Balyan in a case registered under the Maharashtra Control of Organised Crime Act (MCOCA). Special Judge Vishal Gogne also initiated proceedings to declare absconding accused Kapil Sangwan, alias Nandu, a proclaimed offender after he failed to appear despite repeated non-bailable warrants.

Court Proceedings and Non-Bailable Warrants

On June 9, the court issued a second non-bailable warrant against Sangwan and directed him to appear on Friday. However, he again failed to comply. During a hearing on June 3, the investigating officer informed the court that Sangwan’s whereabouts were unknown. The court noted that the Delhi Police, in their charge sheet, sought a trial against Sangwan in absentia under Section 356 of the Bharatiya Nagarik Suraksha Sanhita. It observed that Section 356(1) requires two consecutive non-bailable warrants, issued at least 30 days apart, before trial in absentia proceedings can commence.

Charge Sheets and Allegations

The Delhi Police filed the sixth supplementary charge sheet in the case on April 17. Earlier, on January 24, the court took cognisance of the fifth supplementary charge sheet against co-accused Manoj Yadav. According to the Delhi Police, the case stems from alleged conversations between Naresh Balyan and gangster Kapil Sangwan in 2023, following which an FIR was registered the same year. In October 2025, the Delhi Police invoked MCOCA against nine members of the Kapil Sangwan gang, including former MLA Naresh Balyan and Sangwan’s brother.

Role of Naresh Balyan

Balyan, former AAP MLA from the Uttam Nagar constituency, is accused of actively facilitating extortion activities and providing targets, including local builders, to the gang. His role was revealed during a disclosure made by a co-accused. He is involved in four criminal cases. The court's daily hearings aim to expedite the framing of charges against Balyan, while the process to declare Sangwan a proclaimed offender continues.
