The Delhi Police has approached the high court to challenge the bail granted to a 57-year-old school caretaker who is accused of sexually assaulting a three-year-old girl inside a private school in west Delhi. The accused was arrested on May 1 after the child identified him during the investigation.
Details of the Incident
The alleged incident occurred on April 30 and came to light on May 1 when the child fell ill and informed her mother. Following the complaint, an FIR was registered under Section 64 of the Bharatiya Nyaya Sanhita (BNS) and relevant provisions of the Protection of Children from Sexual Offences (POCSO) Act.
Bail Granted by Sessions Court
The accused was granted bail by a Dwarka sessions court on May 7. The court observed that CCTV footage placed him away from the alleged crime scene at the relevant time and that the child's medical examination did not reveal any injuries. The medico-legal certificate stated that no injury marks or redness were found on the child's body. Additionally, the court noted that the CCTV footage showed the accused allegedly leaving the junior wing of the school at 8:37 am and not returning thereafter.
Prosecution's Opposition
Prosecutors opposed the bail plea, arguing that the allegations were grave and involved a minor child. Despite their objections, the court granted bail with the condition that the accused must stay away from the school premises until the completion of the trial.
Police Challenge in High Court
The Delhi Police has now moved the high court, challenging the sessions court's decision. The police contend that the bail was granted without proper consideration of the seriousness of the offense and the potential risk to the child. The high court is expected to hear the matter soon.
