Gauhati High Court Grants Bail to Psychiatrist in Child Assault Case
The Gauhati High Court on Tuesday provided relief to Dr Sangeeta Dutta, a psychiatrist who was taken into custody in May 2023. She was arrested on serious charges of allegedly assaulting and sexually abusing her two adopted minor children.
Legal Proceedings and Arguments for Bail
The bail order was passed by Justice Anjan Moni Kalita. This development comes nearly three weeks after a different bench of the same court had granted bail to her husband, who is also a doctor, on October 28. A domestic helper was also arrested in connection with this case.
Representing Dr Dutta, her counsel presented a strong case for her release. They argued that the investigating police officials had failed to follow due legal procedures during the time of her arrest. The legal team also brought the court's attention to the prolonged pre-trial detention their client had already undergone and expressed serious concerns over the unusually sluggish pace of the trial proceedings.
Court's Rationale for the Bail Decision
While granting bail, the Gauhati High Court referred to established legal precedents that actively discourage the extended incarceration of individuals who are still under-trial and have not been convicted. The court's decision underscores a fundamental legal principle that prioritizes personal liberty during the investigative and trial phases, especially when the investigation is complete and the trial is moving slowly.
The case has drawn significant attention in Guwahati and highlights the complex interplay between serious criminal allegations and the constitutional rights of the accused. The bail for Dr Dutta marks a pivotal moment in this ongoing legal battle, though the core allegations are yet to be tested and proven in a full trial.
