Patna High Court Mandates Fresh Investigation into School Warden's Death
The Patna High Court has taken decisive action by ordering a reinvestigation into the suspicious death of a school warden in Begusarai, following a botched murder investigation by local police. On Thursday, the court directed the formation of a new investigation team under the supervision of IG Vikas Vaibhav to re-examine the case.
Background of the Case
The case revolves around the death of Rinku Kumari, a warden at Kasturba Gandhi Balika Avasiya Vidyalaya in Muzaffara, Begusarai district. On April 4, 2021, Rinku Kumari left for the school where she worked, intending to collect Rs 15 lakh from her neighbors. This amount was owed to her in exchange for a land transfer agreement that the neighbors had failed to fulfill. Tragically, her body was discovered on the school premises later that day, with a noose around her neck.
Legal Proceedings and Court's Findings
A single bench of Justice Sandeep Kumar presided over the criminal writ application filed by Tejaswini Kumari, the daughter of the deceased. The application highlighted that despite the family naming the neighbors as murder suspects, the Station House Officer (SHO) refused to register an FIR against them, instead classifying the death as a suicide.
Justice Kumar identified serious lapses in the initial police investigation. The local police had ignored critical evidence, including the postmortem report, call detail records (CDR) of Rinku Kumari with the accused, and the ongoing financial dispute over the Rs 15 lakh. In a comprehensive 40-page verdict, Justice Kumar emphasized the importance of a fair investigation, citing Supreme Court rulings. He stated, "Fair investigation is a vital component of the fundamental right of a person for a fair trial as guaranteed by the Constitution, which cannot be denuded away with the lapse of time and progress of lower court’s proceedings."
Court's Directives and Implications
The court has ordered a fresh probe to be conducted by a specialized investigation team, which will be constituted by IG Vikas Vaibhav. This move aims to ensure a thorough and unbiased examination of all evidence, addressing the deficiencies in the previous investigation. The judgment, which was made public through the High Court's website on Thursday, underscores the judiciary's commitment to upholding justice and accountability in criminal cases.
Tejaswini Kumari was represented by counsels Akash Keshav and Akansha Malviya, who argued that the police's failure to properly investigate the murder allegations had compromised the pursuit of justice. The court's decision to order a reinvestigation is expected to bring new insights and potentially lead to the identification and prosecution of the true culprits involved in Rinku Kumari's death.
