Sambalpur Pocso Court Delivers 20-Year Sentence in 2020 Minor Rape Case
In a significant ruling, a special Pocso court in Sambalpur has sentenced a man to 20 years of rigorous imprisonment for the rape of a 14-year-old girl that occurred in 2020. The judgment was delivered on Thursday by the court of additional sessions judge Abhilash Senapati, marking a firm stance against sexual offenses involving minors.
Details of the Case and Legal Proceedings
According to prosecution reports, the accused, who was 17 years old at the time of the offense, established physical relations with the minor under a false promise of marriage. This deceit led to the girl becoming pregnant, and she later gave birth to a child. The case came to light after the survivor's father lodged a formal complaint, prompting police to register a case under relevant sections of the Indian Penal Code and the Protection of Children from Sexual Offences (Pocso) Act, leading to the accused's arrest.
During the investigation, DNA testing played a pivotal role by confirming that the accused was the biological father of the child. This evidence was crucial in securing the conviction, as highlighted by police officials involved in the case.
Court's Additional Orders and Penalties
Beyond the imprisonment, the court imposed a fine of Rs 50,000 on the convict. Failure to pay this fine will result in an additional year of imprisonment, underscoring the severity of the penalties. Furthermore, in a move to support the survivor, the court directed the District Legal Services Authority to provide a compensation of Rs 15 lakh to her, aiming to aid in her recovery and future well-being.
This case underscores the legal system's commitment to protecting minors and ensuring justice in sexual offense cases. The rigorous investigation and DNA evidence were key factors in achieving this outcome, serving as a reminder of the importance of thorough legal processes in such sensitive matters.
