The Bombay High Court recently directed the Maharashtra government to expeditiously address a representation and recruit support staff for the Motor Accident Claims Tribunal (MACT) in Mumbai. Justices Bharati Dangre and Manjusha Deshpande, in an order dated April 22, emphasized that supporting staff form the backbone of any court's functioning. They noted that the absence of key posts such as accounts officer, assistant superintendent, bailiff, and typists hampers court operations. The judges stressed that for the efficient working of the eight presiding officers currently in place, each must be supported by adequate staff.

Background of the Petition

The directive came while disposing of a petition filed by the Bar Association of MACT, which sought the filling of presiding officer posts and highlighted difficulties faced by advocates. The Association's advocate informed the court that all eight courts are now functional with presiding officers, but vacancies remain for support staff appointed by the state government.

Court's Observations and Directions

Since the petition was filed in 2022 and the number of vacant posts may have changed, the court permitted the petitioner-Association to make a fresh representation to the government through the General Administration Department, the competent authority for MACT staff recruitment. The judges observed that the high pendency of cases before MACT is a compelling reason to equip the courts with necessary staff, enabling efficient functioning and expeditious justice delivery.

The court directed that the Association's representation be treated with utmost urgency. It also granted liberty to approach the High Court again if the state government fails to take cognizance and appoint support staff within a short timeframe.
