India at UN calls for review of outdated mediation, rejects Pakistan's J-K remarks

India's Permanent Representative to the United Nations, Harish Parvathaneni, on Tuesday called for a review of outdated mediation frameworks under Chapter VI of the UN Charter during an Arria-formula meeting of the UN Security Council. He also rejected Pakistan's remarks on the Union Territory of Jammu and Kashmir, calling them an attempt to politicise the forum.

India's Stance on Chapter VI and Chapter VII

Speaking at the meeting titled "Bridging the Implementation Gap: UNSC Resolutions and Maintenance of International Peace and Security," Parvathaneni highlighted the distinct nature of Chapter VI and Chapter VII of the UN Charter. "These two Chapters are distinct in nature, and their applicability varies," he said. Chapter VII is intended for concrete actions to address threats to peace, breaches of peace, and acts of aggression, while Chapter VI offers wide-ranging options for peaceful settlement of disputes, including negotiation, enquiry, mediation, conciliation, and arbitration.

Parvathaneni stressed that Chapter VI interventions "are drawn up in order to address the prevailing realities and do not have perpetual validity. They warrant a review in accordance with changing circumstances and contexts." He argued that assuming perpetual applicability of a Chapter VI mediation intervention is erroneous.

Call for Review of Outdated Frameworks

The Indian envoy cited the Palestine issue as a case where mediation frameworks have constantly evolved with changing circumstances. "There exists an undeniable case for reviewing outdated mediation frameworks," he stated. He further argued that UN Security Council mandates should not be exempt from the UN80 framework, which reviews all UN General Assembly mandates for efficiency.

Rejection of Pakistan's Remarks on Jammu and Kashmir

Responding to Pakistan's representative who spoke during the meeting, Parvathaneni said, "It is incredible that a co-Chair expected to be balanced and unbiased in conduct has chosen to politicise this forum." He reiterated India's firm position: "The Union Territory of Jammu and Kashmir is a matter strictly internal to India. It always has been, is, and will remain so."

The Indian envoy's remarks came after Pakistan attempted to raise the issue of Jammu and Kashmir at the UN forum. India has consistently maintained that Jammu and Kashmir is an integral part of the country and that no third-party mediation is required.

Under the UN Charter, Chapter VI is titled 'Pacific Settlement of Disputes' and provides mechanisms for peaceful resolution of conflicts. Chapter VII, titled 'Action with Respect to Threats to the Peace, Breaches of the Peace, and Acts of Aggression,' authorises the Security Council to take enforcement measures, including sanctions or military action.
