The United States Department of Labour has launched investigations and issued subpoenas against entities accused of misusing the H-1B visa programme, Vice President JD Vance announced on Wednesday in Milwaukee, Wisconsin. Vance stated that the Trump administration is committed to preventing the scheme from undermining American workers and protecting taxpayer money.
Fraud Enforcement Effort Targets Visa Misuse
Speaking in Milwaukee, Vance described the action as part of a broader fraud enforcement task force. "We have a programme called the H-1B visa programme. This goes to show how broad-based the fraud task force is. We're fighting for your taxpayer money, but we're also making sure that fraudsters don't take advantage of these visa programmes," he said. The Department of Labour has initiated "dozens of subpoenas and investigations" into entities suspected of exploiting the system.
Purpose of H-1B Programme
The H-1B visa programme was established to allow highly skilled professionals, including scientists, doctors, and technology experts, to work temporarily in the United States in specialised occupations requiring at least a bachelor's degree. Employers must certify that hiring foreign workers will not adversely affect the wages and working conditions of similarly employed US workers.
Vance acknowledged the programme's original intent: "Now why does this programme exist? This is a visa programme that was set up to ensure that if you were a brilliant technology person, or a brilliant scientist, or a brilliant doctor, you could come to the United States and get access to this visa programme."
Allegations of Undercutting American Wages
However, Vance alleged that large corporations and overseas entities are misusing the programme to reduce wages for American workers. "But you know what's happening way too much is that big corporations and fraudsters overseas are using this programme to undercut the wages of American workers," he said. He emphasised the administration's stance: "So you know what we're doing in the Trump administration? We're saying, 'No more. If you are trying to take advantage of that visa programme, you are not allowed in to the United States of America.'"
Impact on Indian Professionals
For India, the development is significant as the H-1B visa programme is a key pathway for Indian professionals seeking employment in the US, particularly in technology, engineering, healthcare, and finance. Indian nationals account for a substantial share of H-1B visa recipients annually due to India's large pool of skilled workers. Changes to the programme are a key issue for New Delhi.
Visa Caps and Current Holders
The H-1B programme is a major component of the US skilled worker immigration system. The US Congress caps annual visas for most private employers at 65,000, with an additional 20,000 slots for candidates holding advanced degrees from US institutions. According to immigration advocacy group FWD.us, approximately 730,000 H-1B visa holders currently reside in the United States, along with nearly 550,000 dependents, including spouses and children.
Vance's Statement on American Jobs
Vance concluded: "American jobs ought to go to American workers and not foreign fraudsters, and the Department of Labour is fighting back against it!" The probe underscores the administration's focus on immigration enforcement and protecting domestic labour markets.
