IMA Demands Fresh Investigation into Bodybuilder's Death, Alleges Rule Violation

The Indian Medical Association (IMA) in Amritsar has strongly criticized the ongoing investigation into the death of bodybuilder Varinder Ghuman, terming it one-sided and flawed. Following the registration of an FIR against four doctors from Fortis Hospital for alleged medical negligence, the IMA is now demanding a completely fresh probe to ensure fairness and transparency.

IMA President Highlights Exclusion as Key Issue

Dr. RS Sethi, the President of the Punjab IMA, has pointed out that the association's representative was not included in the investigation, which he claims is a direct violation of prescribed rules. He emphasized that, according to Punjab government guidelines, it is mandatory to include an IMA member in the District Medical Board formed to probe medical negligence cases.

"This rule ensures that investigations remain impartial and based on expert opinion," Dr. Sethi stated. "Excluding the IMA raises serious concerns about the fairness and undermines the credibility of the entire process."

Serious Lacunae in Inquiry Report Identified

Dr. Amrita Rana, President of IMA Amritsar, and Gurvinder Singh, Financial Secretary, have also voiced their concerns. They highlighted that there are serious lacunae in the current inquiry report, which necessitate an immediate review. The IMA is advocating for the formation of a new Special Investigation Team (SIT) that includes expert doctors to address these gaps.

Dr. Sethi stressed that the participation of all stakeholders is crucial to ensure that conclusions are based on verified facts and that no injustice is done to any party involved. He has formally demanded that the probe be conducted afresh and must include the IMA's nominated member.

Background on District Medical Boards and Legal Framework

The Punjab Government established District Medical Boards in every district to ensure transparent investigations into medical negligence cases. This move follows directions from the Supreme Court of India in the Jacob Mathew vs State of Punjab case, as well as orders from the Punjab and Haryana High Court. The notification for these boards came into effect on February 13, 2026.

As per the rules, each board must include:

  • The Civil Surgeon as Chairperson
  • The Medical Superintendent as Member Secretary
  • Two subject specialists
  • One IMA representative

Dr. Sethi pointed out that in the Ghuman case, no IMA member was included, which he described as a clear violation of norms. The board is designed to examine complaints against both government and private doctors through a transparent process, where all members must be present and sign the final report.

Calling the issue highly sensitive, Dr. Sethi reiterated that the exclusion of the IMA not only breaches protocol but also jeopardizes the integrity of the investigation. The IMA's demand for a fresh probe underscores their commitment to upholding medical ethics and ensuring justice in healthcare-related matters.
