Instant Triple Talaq Alleged in Himachal's Chamba District

A Muslim woman from Playur village in Chamba district, Himachal Pradesh, has lodged a complaint alleging that her husband pronounced instant triple talaq and subjected her to sustained physical and mental cruelty. The Women Police Station in Chamba has registered a criminal case against the husband and his mother under the Bharatiya Nyaya Sanhita (BNS) and the Muslim Women (Protection of Rights on Marriage) Act, 2019.

The complainant, identified as Amna, stated that her husband Rustam and mother-in-law Manira had been repeatedly harassing and threatening her. According to her statement, the harassment included threats to her life and forced eviction from the matrimonial home.

Incident Occurred on June 27 in Presence of Witnesses

Amna alleged that on June 27, 2026, her husband pronounced 'talaq' three times in the presence of her brother Liaqat Ali and a neighbour named Anju. Following the pronouncement, she was forced to leave the house. The instant triple talaq, also known as talaq-e-biddat, is illegal under the 2019 Act, which makes it a criminal offense punishable with imprisonment.

The police have invoked Sections 85, 351(2), and 352 of the Bharatiya Nyaya Sanhita, which pertain to criminal intimidation and cruelty, along with Section 4 of the Muslim Women (Protection of Rights on Marriage) Act. The mother-in-law has been booked for her alleged role in the harassment.

Police Confirm Investigation Underway

Superintendent of Police Vijay Saklani confirmed that a case has been registered based on the woman's complaint and that efforts are underway to apprehend the accused. The Muslim Women (Protection of Rights on Marriage) Act, 2019, was enacted by Parliament to declare instant triple talaq illegal and void, and to provide legal protection to Muslim women against such practices.
