A 35-year-old stage singer and dancer has filed a complaint against a sub-inspector (SI), two head constables, and a doctor, accusing them of rape and sexual exploitation. The accused allegedly promised to assist her in a legal case involving another man. An FIR was registered on Tuesday night at City Palwal police station against SI Manoj, head constables Mahender and Ankur, and Dr Rajesh, among others, under relevant sections of the Bharatiya Nyaya Sanhita (BNS). The charges include rape by a person in authority, sexual harassment, assault, criminal intimidation, and common intention.
Background of the Case
According to a police officer, all accused work as home guards in the city. The complainant, who got divorced a year and a half ago and has three children, met the accused in February. After verifying her complaint submitted on June 2, the police found sufficient grounds to register the case. The investigation has begun, and statements of the accused will be recorded.
Previous Allegations
The woman had earlier filed a case against a man she accused of sexual exploitation and causing a miscarriage by administering abortion pills. That FIR was registered at Camp Palwal police station in February under BNS and POCSO Act sections but was later cancelled. While pursuing that case, she came into contact with head constable Mahender, who promised help and introduced her to SI Manoj.
Details of the Allegations
The complainant alleged that about four months ago, Manoj and Ankur visited her home in plain clothes and took her to Faridabad under the pretext of assisting her case. According to the complaint, Manoj took her to a place where alcohol was served and gave her a cold drink, after which she felt intoxicated. She regained consciousness the next morning in a room with Manoj, accusing him of non-consensual physical relations. She further alleged that Manoj later continued a relationship with her by promising marriage and arranged a rented accommodation in HUDA Sector-2, Palwal. He allegedly brought his colleagues, including Mahender, Ankur, and Dr Rajesh, to her house, where they consumed alcohol and made inappropriate remarks. Dr Rajesh once misbehaved in front of Manoj, who did not intervene. Ankur allegedly sent obscene messages, which she claims are saved on her phone. When the woman learned that Manoj was already married with children, he stopped contacting her, abused her, and threatened her.
Legal Provisions Invoked
The FIR includes BNS sections 115 (voluntarily causing hurt), 123 (causing hurt by poison with intent to commit an offence), 3(5) (common intention), 351(3) (criminal intimidation by threatening death or grievous hurt), 64(2)(m) (rape repeatedly on the same woman), 74 (assault or criminal force to outrage modesty), and 75(2) (sexual harassment).
