The Faizabad Bar Association has passed a resolution barring its members from representing the eight accused arrested in the Ram Temple donation embezzlement case, threatening a Rs 5 lakh penalty for any lawyer who defies the order. The decision, announced on Monday, has drawn sharp criticism from legal experts who assert that it infringes upon the fundamental right of every accused to legal representation.
Bar Association's Resolution and Demands
Bar Association secretary Shailendra Jaiswal stated, "The sentiments of all of us have been hurt by the theft of temple offerings. The lawyers of Faizabad have agreed not to plead on behalf of the arrested accused." The association also demanded that Champat Rai, Anil Mishra, and Gopal Rao—individuals associated with the management of the Ram Temple but not named in the FIR—leave Ayodhya within three days. Failure to comply would result in a blockade of the temple town, with no one allowed entry.
Legal Experts Condemn the Move
Former chairman of the Bar Council of Delhi, KK Manan, criticized the resolution, calling it "unfortunate." He emphasized, "To have legal assistance from a lawyer of his choice is the right of every accused. A Bar association can’t pass a resolution to prevent lawyers from representing the accused in a case. Rather, it’s their duty to provide legal assistance to the accused." Manan further noted that an accused is presumed innocent until proven guilty, and lawyers must not refuse legal assistance.
Background of the Case
The eight accused were arrested in connection with the alleged embezzlement of donations collected for the Ram Temple in Ayodhya. The case has stirred strong emotions among locals, leading to the Bar association's unprecedented step. However, legal experts warn that such resolutions undermine the principles of justice and the right to a fair trial enshrined in the Indian Constitution.
