The Uttarakhand High Court has denied bail to a woman accused of forcing her 13-year-old daughter into sexual relations with a co-accused, emphasizing the serious nature of the allegations and the welfare of the minor. Case Background

The case originates from a complaint filed in Haridwar by the victim's father. He alleged that the woman made the minor consume alcohol and took her to multiple cities for sexual exploitation. According to the prosecution, the girl was allegedly taken to Haridwar, Agra, Ghaziabad, and Vrindavan, where the abuse continued over an extended period.

Defense Arguments

Seeking bail, the accused argued that the victim had been enrolled in a residential school during the period mentioned in the complaint. The defense also cited a delay of nearly five months in filing the First Information Report (FIR), claiming it cast doubt on the prosecution's version. However, the court dismissed these arguments, stating that inconsistencies or delays should be adjudicated by the trial court, not during bail proceedings.

Court's Observations

Justice Mehra stated that while the mother has been in custody since June 2025, the duration of jail time cannot be a basis for bail in such serious cases. The court held that the allegations are grave and involve the welfare of a minor, making bail inappropriate at this stage.

The state government opposed the bail application, and the court agreed with their stance. The case underscores the judiciary's commitment to protecting minors from sexual exploitation, even when the accused is a parent.
