The Gurugram police have registered a preventive legal case against five individuals following the circulation of a viral video on social media that depicted the assault of a civil engineer. The action was taken under Sections 126 and 170 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) to avert any potential breach of peace.
Incident Details and Complaint
The complainant, a resident of Andour Heights in Sector 71, Gurugram, reported that a group of youths in a Thar vehicle assaulted him. The video of the incident spread rapidly on social media platforms, prompting police intervention. The complainant lodged a formal complaint at the Badshahpur police station.
Upon receiving the complaint, the police initiated an inquiry and summoned both parties to the station for questioning. The complainant, however, declined to undergo a medical examination, which is standard procedure in assault cases. The police also examined the viral video as part of their investigation.
Preventive Legal Action Under BNSS
During the investigation, authorities identified a potential risk of disturbance to public order and peace. Consequently, they invoked preventive legal provisions under Sections 126 and 170 of the BNSS. These sections empower the police to take preemptive action to prevent offenses and maintain law and order.
The five accused individuals were identified as Akash, a resident of Mughalsarai in Chandauli district, Uttar Pradesh; Deepak, from Shahpur in Kangra district, Himachal Pradesh; Nikhil Jaiswal, from Vishrampur in Surajpur district, Chhattisgarh; Abhishek Dwivedi, from Panchrukha in Deoria district, Uttar Pradesh; and Varun Chaudhary, from Kakar Khera, Shardapuri Phase II, Meerut, Uttar Pradesh.
Background of the Dispute
According to a spokesperson for the Gurugram police, the accused had rented a flat in the same residential society as the complainant. On the day of the incident, they had arrived to move their belongings. During the shifting process, the complainant's vehicle allegedly obstructed their movement, leading to a verbal argument that escalated into a physical assault.
