Dehradun Court Clears Man of Rape Charges as Complainant Withdraws Allegations
A Dehradun court has acquitted a man accused of rape after the complainant, a nursing student, retracted her allegations during the trial. The woman admitted in court that she fabricated the entire case.
Complainant Admits to Fabricating Rape Allegations
In her final statement before a fast-track court of the additional district judge in Dehradun, the woman said she had been in a relationship with the man for three years. She filed the case against him after he uploaded a picture of her on social media.
The woman confessed that all her allegations were false. She stated she made the rape allegations under the influence of others who instigated her to do so.
Original FIR and Prosecution Claims
The FIR was registered in December 2022. The woman initially alleged that the man took her to a hotel near the city ISBT and gave her a spiked drink. The prosecution claimed that after she became unconscious, he raped her and took obscene pictures and videos.
She alleged these materials were later shared with her relatives and uploaded on social media using a fake account created in her name. The woman also claimed the accused pressured her to marry him, which she refused.
Detailed Allegations and Charges
The woman claimed the man repeatedly raped her between May 2021 and November 2022. She said he blackmailed her during this period. Following these allegations, the accused was charged under IPC sections 376 (rape), 504 (intentional insult with intent to provoke a breach of the peace), and 506 (criminal intimidation).
After the FIR registration, the complainant underwent a medical examination. However, the doctor did not give a conclusive opinion regarding sexual intercourse. She also alleged the accused threatened her family with serious consequences if the FIR was not withdrawn.
Court Examination and Final Ruling
The court examined the pictures uploaded on social media. It found that they were not obscene. Noting that the complainant had retracted her allegations during the trial, the court ruled on Tuesday that the accused was entitled to acquittal.
