A 57-year-old businessman in Hyderabad has approached the Central Crime Station (CCS) police, alleging that his brother, in collusion with other family members and the Doodhbowli sub-registrar, created a fake will in the name of their late father and fraudulently registered two properties in Begum Bazar, valued at approximately Rs 20 crore, in their favor.
Police Register Case Against Five Accused
Police have registered a case against five accused, including the sub-registrar, and have launched an investigation into the matter. According to CCS officials, the complainant, Venugopal Toshniwal, a resident of Mangalhat, submitted a complaint on May 1, alleging forgery, fabrication of documents, and illegal transfer of family properties.
Details of the Complaint
In his complaint, Venugopal stated that his father, the late Brij Gopal Toshniwal, purchased a 240-square-yard property at Bhaji Mandi in Begum Bazar along with family members through a registered sale deed in 2011. He further stated that his father also owned a 95-square-yard property at Nagar Khana in Begum Bazar, purchased through a registered sale deed in 2006.
Venugopal informed the police that his father died on September 7, 2012, and never executed any will during his lifetime. He alleged that after his father's death, his brother Umesh Kumar Toshniwal conspired with his sister Suman Bang, her husband Giri Raj Bang, and the Doodhbowli sub-registrar to fabricate a will dated December 9, 2011.
Based on this allegedly forged will, Umesh Kumar Toshniwal executed gift deeds in favor of his wife Kavita Toshniwal in 2024 and 2025 for both properties. Additionally, when Venugopal sought a certified copy of the will through an RTI application, the sub-registrar's office replied that the document was not available, the complainant alleged.
Legal Action Taken
Based on Venugopal's complaint, the CCS police registered a case under Sections 318(4) (Cheating and dishonestly inducing delivery of property), 338 (Forgery of valuable security, will, etc.), 340(2) (Using as genuine a forged document or electronic record) read with 61(2) (Criminal conspiracy) of the Bharatiya Nyaya Sanhita (BNS) against Umesh Kumar Toshniwal, Kavita Toshniwal, Suman Bang, Giri Raj Bang, and the Doodhbowli sub-registrar.
CCS police officials stated that they are collecting evidence and the case is under investigation. No arrests have been made so far.
