The horrific event occurred on August 13, 2023, when the child's father, a laborer, was at work in a Firozabad factory, and her mother had gone to nearby fields to collect fodder. Upon returning home around 2 PM, the father found the door locked and heard his daughter crying inside. Forcing the door open, he witnessed the accused violating his daughter. The perpetrator fled after shoving the father to the ground. The father recognized the man, who frequently visited the village to see relatives, adding a layer of betrayal to the crime.
Legal Proceedings and Conviction
Based on the father's police complaint, a case was registered under Section 376AB of the Indian Penal Code, which pertains to raping a girl under the age of 12, and Sections 5/6 of the POCSO Act. The accused was arrested on the same day, and the girl was promptly sent for a medical examination to gather crucial evidence.
During the trial, the survivor bravely gave her statement before the court. Her testimony, combined with medical evidence and witness accounts, formed a compelling case that led to the conviction.
