SC refuses to suspend Asaram's life sentence in rape case

The Supreme Court on Tuesday refused to suspend the life sentence awarded to self-styled godman Asaram, who was convicted in a 13-year-old case of raping a minor. A Bench of Justice MM Sundresh and Justice Sheel Nagu declined to grant bail at this stage, stating that they would consider it only if there is a grave necessity, such as a threat to his life.

Court's Observations and Notice to Rajasthan Government

“We are not granting bail now. Subject to hearing the state..., we will consider (it) if there is grave necessity to grant bail... like in conditions where his life is in danger,” the Bench said. However, the court issued notice to the Rajasthan Government on Asaram's petition challenging the state high court’s order that upheld his conviction and life sentence. The government has been asked to file its reply within two weeks.

Medical Facilities and Bail Considerations

The Supreme Court directed jail authorities to provide medical facilities to Asaram, who is over 80 years old and suffering from various ailments, as submitted by his senior counsel DS Naidu. The court clarified that it will consider granting bail only if there is any grave health condition.

Background of the Case

Asaram was convicted on April 25, 2018, for sexually assaulting a minor student at his ashram. He was sentenced to life imprisonment under multiple provisions of the Indian Penal Code, the Protection of Children from Sexual Offences (POCSO) Act, and the Juvenile Justice Act. The Rajasthan High Court, on May 27, upheld his conviction but acquitted co-accused Sanchita Gupta alias Shilpi and Sharat Chandra.
