The Supreme Court on Friday expressed strong displeasure over the non-production of witnesses in the Lakhimpur Kheri violence case, which resulted in the deaths of several people in October 2021. A bench comprising Justices Vikram Nath and Prashant Kumar Mishra was hearing a petition seeking a fair investigation and speedy trial in the case.
Court's Observations
The bench noted that despite repeated directions, the prosecution had failed to produce key witnesses before the trial court. "This is a serious matter. Witnesses are not being produced, and the trial is getting delayed. We are not happy with this," the court observed.
The Supreme Court also directed the trial judge to file a status report on the progress of the case within four weeks. The report should detail the steps taken to ensure the production of witnesses and the reasons for any delays.
Background of the Case
The Lakhimpur Kheri violence occurred on October 3, 2021, when a convoy of vehicles carrying Union Minister Ajay Mishra Teni allegedly ran over protesting farmers, leading to a clash that left eight people dead, including four farmers, a journalist, and a driver. The incident sparked widespread outrage and political controversy.
The case is being heard in a trial court in Lakhimpur Kheri, where charges have been framed against several accused, including Ashish Mishra, the son of the Union minister. The trial has been marred by delays, with the prosecution citing difficulties in producing witnesses due to threats and intimidation.
Next Hearing
The Supreme Court has posted the matter for further hearing after six weeks, by which time the status report from the trial judge is expected to be submitted. The court also warned that it would consider transferring the trial outside Uttar Pradesh if the situation does not improve.
The petition was filed by the families of the victims, seeking a fair trial and justice for the deceased. The court's intervention comes amid growing concerns over witness safety and the pace of the judicial process in high-profile cases.
